			<content:encoded><![CDATA[<p>MACC in their first statement after Beng Hock&#8217;s death (while late Beng Hock&#8217;s body was still lying outside their window) was that Beng Hock was released at 3.45am on July 17, 2009.</p>
<p>Beng Hock&#8217;s mobile phone whereabouts can proof or disprove MACC&#8217;s claim.</p>
<p>1. Beng Hock&#8217;s mobile phone is not on him.</p>
<p>2. Police says the mobile phone is missing.</p>
<p>3. Through out MACC&#8217;s custody of Beng Hock, no phone call got through. I.E. no ringing tone. Nobody could reach Beng Hock on the mobile from 6pm July 16, 2009 onwards.</p>
<p>4. Beng Hock&#8217;s body was discovered between 1pm &#8211; 1.30pm.</p>
<p>5. A reporter manage to get a ringing tone on Beng Hock&#8217;s mobile sometime between 3-4pm. Nobody picked up the call.</p>
<p>6. Beng Hock&#8217;s mobile phone could no longer be reach. Police claimed it is missing.</p>
<p>It&#8217;s known that MACC takes custody of mobile phone through out the interrogation.</p>
<p>So, if Beng Hock&#8217;s mobile phone is not on him. That would mean he has not been released by MACC.</p>
<p>MACC can not claimed that the mobile phone is with them still because it will proof that they were lying right from the beginning about releasing Beng Hock at 3.45am.</p>
<p>Where is Beng Hock&#8217;s mobile phone, MACC? We know you were having it!</p>

<p><em>At the First Party Congress held in Setapak, Kuala Lumpur, on 29th July, 1967, the following declaration known as The Setapak Declaration containing the basic guiding policies and principles of the party was adopted. This Declaration is reproduced for record purpose only.</em></p>
<p><strong>Introduction</strong></p>
<p>WE, the Chairman and Members of the Central Executive Committee of the Democratic Action Party together with Members of Branch Committees of the Party, here assembled at Setapak, Kuala Lumpur, on 29th July, 1967, hereby re-state and reaffirm the basic guiding policy and principles of the Democratic Action Party, as given hereunder.</p>
<p>We firmly resolve to continue to be governed in all our activities and in all our approaches to the social, political, economic and cultural problems in Malaysia, by the same basic guiding policy and principles.</p>
<p><strong>Objectives</strong></p>
<p>The D.A.P. is irrevocably committed to the ideal of a free, democratic and socialist Malaysia, based on the principles of racial equality, and social and economic justice, and founded on the institutions of parliamentary democracy.</p>
<p><span id="more-665"></span></p>
<p>We believe that it is possible to mobilise the support of the big majority of the multi-racial people of Malaysia in the pursuit of this aim, and we shall regard it as our primary objective to mobilise such support.</p>
<p>We are aware that in the pursuit of our aims, we shall meet with serious resistance, not only from the Alliance Party and Government, but also from political forces hostile to the Malaysian nation and inspired by foreign powers and ideologies.</p>
<p>We reaffirm that the D.A.P. intends to be guided by purely Malaysian perspectives and aspirations. We shall not allow ourselves to be deflected from our chosen path by either the reactionary and communal right wing, or by the foreign-inspired anti-Malaysia left. Neither shall we lend ourselves to manipulation by either of these two groups.</p>
<p>In order to achieve our primary objective, the most vital condition must be success in the process of nation-building in a multi-racial society. But it is precisely in the vital process of nation-building that the Alliance Government has been guilty of a gross and shameful betrayal of national trust.</p>

<p>The simple quantitative measurement for problem with network is via packet loss. And I quote from wikipedia :</p>
<blockquote><p>Packet loss occurs when one or more packets of data travelling across a computer network fail to reach their destination. Packet loss is distinguished as one of the three main error types encountered in digital communications &#8230;</p></blockquote>
<p>This morning, packet loss to :</p>
<ul>
<li>limkitsiang.com stand between 45% and 60%</li>
<li>mirror.switch.ch stands around 50%</li>
<li>www.adobe.com stands between 50% and 80%</li>
<li>fedoraforum.org stands between 40% and 65%</li>
<li>news.bbc.co.uk stands above 50%</li>
<li>www.facebook.com stands between 45% and 55%</li>
</ul>
<p>Due to the very high packet loss, websites like www.adobe.com and fedoraforum.org could not load at all. And <a href="http://blog.limkitsiang.com">Mr Lim&#8217;s blog</a> is also virtually unreachable from our office.<br />

Those were some of the destinations that were affected.</p>
<p>2.<br />
Regarding Source :</p>
<p>What make matters worst is that TM Net does not practise network neutrality. </p>
<p>I would like to quote network neutrality from wikipedia:</p>
<blockquote><p>Network neutrality (also net neutrality, Internet neutrality) is a principle proposed for residential broadband networks and potentially for all networks. A neutral broadband network is one that is free of restrictions on content, sites, or platforms, on the kinds of equipment that may be attached, and on the modes of communication allowed, as well as one where communication is not unreasonably degraded by other communication streams.</p></blockquote>
<p>TM Net discriminate the Internet Protocol (IP) address of its customers. They do this by reserving class or groups of IP address according to package. And in their network set up, they give priority to some IP address over the other.</p>
<p>How this relates to the packet loss? Because of the lost of network neutrality, TM Net bandwidth are not distributed equally and fairly which related to my point earlier that the level of disruption is dependent on the source and destination.</p>
<p>3.<br />
I would like to highlight a ridiculous point of Package Detail on <a href="http://www.streamyx.com.my/get_streamyx/get_streamyx.php?id=getstreamyx_package_Details">Streamyx website</a> :</p>

<p>For the record, TM Net through is parent company Telekom Malaysia owns exclusive landing rights for International Submarine Communication cables up to this year.  Up to this year because Maxis have joined Telekom in Asia-America Gateway (AAG) which suppose to come online this year.</p>

<p>With 11 International Submarine Communication tables, how can TM Net disclaim the International Internet speed?</p>
<p>As a final point, I would like to quote Streamyx Terms and Condition :</p>
<blockquote><p>Streamyx Terms and Condition </p>
<p>22.2     TM shall use its best endeavours to ensure the continuity and efficiency of the Service at all times but shall not be liable for any loss, damage, consequential or otherwise, arising out of any failure of the Service caused unless such default, error, omission or loss is due to the willful neglect or fault of TM. Notwithstanding the aforementioned, the extent of <strong?TM’s liability shall be limited to correcting the failure of the Service only.</strong></p></blockquote>
<p>TM Net have failed since December 2008 to address the issue of packet loss due to its network problems. In conversation with TM Net personal, TM Net is only concern that users are able to have Internet service, how unreliable or slow is not of their concern.</p>
<p>The problem with I have described earlier, namely packet loss to “selected” (for lack of a better word) destination from “unlucky” source have been on going since end of last year. This issue was highlighted in Parliament by Sdr Chong Chien Jen MP for Bandar Kuching on 18th March 2009 yet till today, we keep on seeing the same problem getting very worst at different time.</p>
<p>A total liberalisation of Internet service, whether it is at distribution (last mile) or whether it is landing site for International Submarine Cable is a must, to lift this plague of horrible Internet service by TM Net.</p>

<p>Malaysia appeared to be on the brink of joining other Asian countries in recession as it reported on Friday that gross domestic product grew by only 0.1 per cent in the final quarter of 2008 from a year ago, the slowest rate in seven years.</p>
<p>The manufacturing sector contracted by 8.8 per cent in the period after posting positive growth for the past 26 quarters as exports slumped, particularly in the mainstay electronics industry. Exports in goods and services fell 13.4 per cent.<br />
<span id="more-649"></span><br />
The latest data, which fell short of market expectations, is expected to increase pressure on the government to unveil a large stimulus package scheduled for March 10 to save jobs. The government may spend as much as M$30bn in the new budget proposal after injecting M$7bn in extra spending in November. The central bank recently has cut interest rates in three steps to 2 per cent to revive growth.</p>
<p>Malaysia does not give quarter-on-quarter growth rates, but the economy expanded by 4.7 per cent in the July-September period last year. Full-year GDP growth was 4.6 per cent against 6.3 per cent in 2007.</p>
<p>Economists said that Malaysia is unlikely to avoid a recession, its first since 1998, in spite of the stimulus package, although services expanded moderately by 5.6 per cent, down from 7.1 per cent in the third quarter.</p>
<p>Malaysia had predicted a growth rate of 3.5 per cent for 2009, but Najib Razak, the finance minister and incoming prime minister, recently conceded that the government will be forced to cut its forecast.</p>
<p>Several big electronics factories in Malaysia are being closed, raising fears that the unemployment rate could double to 6 per cent by 2010 if global demand remains weak. Retrenchments in the manufacturing sector rose by 86 per cent last year.</p>
<p>Malaysia also must deal with a sharp fall in price of its main commodities, including oil and gas and palm oil. The central bank warned that ”risks remain on the downside and recovery is likely to be slow and protracted.”</p>

<p>However, I would like to warn the Pakatan Rakyat&#8217;s legislator do not be fixed like deer staring at the headlights on just calling for Press Conference to highlight the causes.</p>
<p>Your role as legislator is more than that. If you need me to teach you what to do, which most of you clearly does. Then I guess its time to work on the next step for Malaysia. Yes, Pakatan Rakyat have done a wonderful job in denying the BN 2/3 majority. But, really is it your work? Or is it the civil society sacrifices? The blogspheres? Those who went down to the streets during Bersih march? You did not win your seat in vacuum. Wake up now or you will be shocked to the reality in the next General Election.</p>
<p>After 5 months since March the 8th, I am still very disappointed with the quality of legislator we have in the Parliament. You can do more than TALK in Parliament. Even fools can do that as demonstrated well by the BN backbenchers.</p>
<p>Be a legislator! A good one at it.</p>
<p>So DO YOUR HOMEWORK!</p>
